Email Policy


The use of services from Reselhost, LLC [hereafter referred to as "Reselhost"] constitutes agreement to these terms. You may view our Privacy Notice here.

  1. 1. Limits

    There is a 100 outgoing email hourly limit per domain. This limit is also applied towards Mailman. If you send over this amount in any hour, most of the e-mails will bounce back with an undeliverable error. If this occurs, it will then take some time for your account to be able to send again so we recommend waiting at least 1 hour after this issue occurs to begin sending email again.

    Many of our servers have a limit of 30 POP3/IMAP checks per hour per each user's connecting IP address. If you go over this you're likely to get a wrong password error message or an error stating "login incorrect". If this occurs, please wait an hour and it will automatically unblock you. To prevent this from happening again, please make sure to disable auto checking or at least set it to something higher such as once every 10 minutes.

    Any mailing list larger than 100 addresses will require a dedicated server or VPS hosting solution from us. Note: Dividing one large list into smaller lists to get below this limit is not allowed.

    There is also a limit to the number of Mailman mailing lists permitted as follows (NOTE: This does not apply to other mailing list programs such as PHPList. This only applies to Mailman.)

    3. Business package: 15 Mailman mailing lists

  2. 2. Mailing Lists Rules

    1. Any time you're sending a message no matter how large your e-mail list is you must throttle it. We recommend you throttle it to at the very least sending 1 email every 8 seconds. (Sending 1 every 8 seconds would send 100 emails within 1 hour, keeping you below the 500 outgoing email limit.) If the mailing list software you're using does not allow you to throttle you must switch to an application or script that will. We recommend PHPList, which can be found in your CPanel, under Quickinstall.

      IMPORTANT: If you do not throttle and you try sending 100 emails, the server will try sending all 100 in 1 second which is not possible on our shared servers. This will cause a very high load on the server and the entire server will be sluggish, potentially affecting your sites and service, until this sending process is completed. It is our job to keep the server up and running without being sluggish or experiencing issues. Anyone who causes the server's load to go high will be suspended and the process will be terminated. If you choose not to throttle, you will most likely be suspended for crashing the server.

    2. Any mailing list over 100 email addresses is only allowed to be sent to during off-peak times to prevent high server loads. Off peak times qualify as all day Saturday and Sunday, and 1AM - 8AM Eastern Standard Time, Monday through Friday.

    3. The list must be a Double Opt-In list. This means a user has subscribed for a newsletter or other email marketing messages by explicitly requesting it and confirming the email address to be their own. Confirmation is usually done by responding to a notification/confirmation email sent to the email address the end user specified. The double opt-in method eliminates the chance of abuse where somebody submits someone else's email address without their knowledge and against their will. You will not be permitted to mail any mailing list that you were given or purchased. In doing so, this will also be considered spamming and may result in termination of the offending account.

      Email Scripts must be able to handle and document all information from a double opt-in list. This includes recording the sign-up IP address and date/time, double opt-in verification IP address and date/time, processing opt-outs (via web or email), and list removal on bounce backs. All opt-outs or bounce back removals must be handled in a timely manner, and outbound mail must be throttled on shared packages to a maximum of five hundred (500) emails per hour. If your account is found to be using a script that does not meet these requirements, Reselhost reserves the right to suspend, terminate, or deactivate your script or account.

    4. Any unsolicited e-mail being sent will result in suspension or termination of the offending account. We take a zero tolerance stance against sending of unsolicited e-mail and other forms of spam.

    5. Any mailling list MUST comply with all guidelines set forth by the United States government. These can be found at:

    6. No direct SMTP mailers are allowed. An example of this would be a Darkmailer or The Bat!. Any mail should be sent through the local mail server/MTA for further delivery by the server and not done directly by scripts.

    7. 3. Anti-Spam Policy

      For the purposes of this document, "policy" should be understood as a series of measures to achieve a goal. The purpose intended by RESELHOST LLC. is to combat the practice of SPAM, as stated in the "ANTI-SPAM COMMITMENT" and the measures adopted are divided into:

      • a) INFORMATIVE OR EDUCATIONAL: Intended to clarify not only RESELHOST clients, but also the general public WHAT SPAM IS and ways to minimize notifications of SPAM practices.
      • b) TECHNOLOGICAL: consisting of technical instruments for the availability of two RESELHOST clients not only to avoid receiving SPAM (such as filter list, hidden nickname, blocked electronic corrections, confirmation of origin, etc.) as well as to avoid being accused of the practice of SPAM (active confirmation of registration), and;
      • c) REPRESSIVE: consisting of contractual provisions that authorize RESELHOST to withdraw, summarily, the sites of clients that violate the ANTI-SPAM COMMITMENT assumed on the occasion of contracting two RESELHOST services.

      RESELHOST, in sync with the best practices of the Internet and the most influential non-governmental organizations on the Internet, and following the call of its users, publicly declares its anti-SPAM commitment. Through it, RESELHOST undertakes to hinder, by all means at its disposal, the practice of SPAM and to disclose the repudiation of this practice, as well as the purpose of preventing its clients from executing it.

      On the other hand, everyone who becomes a client of RESELHOST accepts, fully and without restrictions, automatically, by the simple act of contracting any service provided by RESELHOST, the commitment NOT TO PRACTICE SPAM IN ANY OF ITS MODALITIES OR MANIFESTATIONS.

      Therefore, all RESELHOST clients are obliged to follow the rule of rejection of SPAM, being responsible for compliance with the rule of not practicing SPAM in any hypothesis and under any pretext.

      IF THE SENDING OF SPAM IS CONFIRMED BY A CUSTOMER, THEIR "SITE" WILL BE REMOVED FROM THE AIR UNDER THE TERMS PROVIDED IN THE RESPECT CONTRACT, WITHOUT PREJUDICE TO OTHER APPLICABLE MEASURES.

      RESELHOST clients are prohibited from receiving more than 10% (ten percent) of bounced e-mails, unless another limit has been expressly established in the contract signed with the client, hypothesis in which the fixed limit will prevail contractually. "Bounced e-mail" is understood as any type of error that compromises the delivery of the message to its recipient. One of the most common errors is the destination mailbox does not exist. In this way, if the RESELHOST client receives a percentage of e-mails greater than the 10% specified above, the presumption, by RESELHOST, of the practice of SPAM by the client will operate. The email for SPAM complaints that, eventually, has been practiced by an RESELHOST client are abuse@reselhost.com.

      Basic information on the characterization of spam practice

      What is SPAM?

      In an objective way, SPAM, for the purposes of this commitment, can be defined as the sending of e-mails and/or any other type of electronic message that motivates a complaint from any recipient of the same and/or from any organization and/or or individual with functions of combating and repressing the practice of SPAM.

      SPAM is not a viable means of propaganda. Although it is very tempting to use it as an advertising medium, it is forcing the entire Internet to change the regulations on the use of the e-mail system and increasing its restrictions and punishments against companies that practice SPAM. It is also important to always denounce SPAM, which is a negative practice for the Internet and only through complaints can we combat it.

      Why is SPAM a problem?

      The Internet today is an extremely dynamic, complex and information-rich environment. Email is one of the components of the Internet, and today it is one of the main means of communication within it. However, this means of communication has been increasingly degraded by the high number of e-mails, not only advertisements but also jokes or any other type of e-mail sent indiscriminately, without being requested by the recipient. This is SPAM. This degradation translates into a high use of space for storing messages, overloading the servers that manage and transmit emails, overloading communication networks, etc.

      In addition, more and more unsolicited e-mails are ignored by the recipients, who even repudiate the companies that send them. Thus, even commercially SPAM is becoming highly inadvisable.

      Basic instructions to minimize accusations of spam practice

      Precautions

      Do not send "press releases" in which recipients would like to receive them. Don't have a "register your email" field on your site without faithfully following the "Active Confirmation" described in this document.

      Don't buy email lists. This is, to say the least, illegal, and will likely lead to SPAM claims for your site.

      No credit is given to any seller to guarantee that their e-mail list is approved by the recipients to receive messages. Isso is a lie.

      Do not believe if any vendor guarantees that your email list is approved by recipients to receive messages. That's a lie. If a visitor to your site registers as your customer, it does not mean that he has agreed to receive advertising from you. He must explicitly ask to receive your marketing emails. If you have a program that logs all the email addresses of people who submit questions to your site and uses that list to send emails, you will surely be accused of SPAM.

      There is no Brazilian legislation on the matter, so any argument that e-mails sent cannot be considered SPAM due to any congress or legislation, both national and foreign, is invalid.

      The ideal way to make a record of any kind to validate the reception of e-mails is through a process called here "Active confirmation of registration". It is based on forcing an explicit request to a visitor if it is included in your registration and, therefore, ensuring that you have to accept it in receiving future communications. This technique is particularly useful in those cases where you want to build your e-mail registry without running the risk of being accused of SPAMMER for having accepted an address without the effective authorization of the owner of the address. This happens a lot when there is a "Tell a friend" type field on your site, which causes many "Friends" to be indicated without them knowing, and therefore considering any communication you make to them as SPAM.

      How to implement active confirmation:

      If you have a "Tell a Friend" type field and register an email address to receive communications, DO NOT insert it into your registration yet;

      If there is a client registration form, make sure that there is a very clear "checkbox", saying that the client agrees to receive information, advertisements, etc. from the site; Send an email immediately to the registered address with a very clear and objective text, WITHOUT PROPAGANDA, only with the information that someone indicated that email address to continue receiving communications from your site, and if you really want to receive such communications they must respond to the e-mail with some predefined text; Only if you receive such a response, and it is affirmative, enter the e-mail address in your registration; Save the confirmation e-mail as it will be your only proof of the visitor's explicit acceptance to receive your communications. Important: This process is not a guarantee that your site will not be accused of SPAM,

      ATTENTION

      In the event that it is not a hypothesis of immediate deactivation of the site, RESELHOST reserves the right to demand, for the maintenance of the provision of the service, that the site accused of this practice MUST use the technical resource, of "Active confirmation of registration". In addition, depending solely on a subjective analysis of RESELHOST, the case may be considered serious and the disablement of the list of emails used by the site may be imposed, in order to ensure that the site does not continue sending potentially unwanted emails to certain addresses.
